Terms of Service

1. Agreement to Terms

By accessing or using the Tilesy website or mobile application (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms apply to all users of the Service, including game hosts, players, and visitors to the website.

2. Description of Service

Tilesy is a group photo bingo game. A host creates a game session, chooses a challenge pack, sets the rules, and shares a game code. Players join with the code and race to take photos that complete tiles on their bingo grids.

No account or registration is required to play. Players enter only a display name for each game session.

3. Free and Premium Tiers

Tilesy is free to download and use, subject to the following limitations:

Free Tier

Unlimited free plays
Up to 4 players per game
Access to free challenge packs, including Household hunt and Nature hunt
Game data retained for 24 hours after the game ends, then deleted

Premium Tier

Unlimited players per game
Access to Premium packs, including Birthday bash, Wedding day, Team building, and School & kids
Photo downloads where available
Game data retained for 7 days after the game ends, then deleted

Premium features are available via a one-time in-app purchase processed through the Apple App Store or Google Play, subject to their respective terms and payment policies. Premium is not a subscription. All fees are non-refundable except as required by applicable law or as provided by the relevant app store's refund policy. If app will ever be discontinued, Premium features will remain available for at least 12 month after the last app update.

4. User Content

"User Content" means any photos, display names, or other content submitted by you through the Service during a game session.

Licence Grant

By submitting User Content, you grant Tilesy a limited, temporary, non-exclusive licence to store, transmit, and display that content solely for the purpose of operating the game session, showing results, and providing the gallery features. This licence expires when the game data is deleted.

Your Responsibility

You are solely responsible for the User Content you submit. You must not submit content that:

Is unlawful, harmful, threatening, abusive, harassing, or defamatory
Infringes any third-party intellectual property, privacy, or other rights
Contains nudity, sexually explicit material, or graphic violence
Depicts or encourages illegal activity
Includes photographs of individuals taken without appropriate consent

We reserve the right to remove content that violates these Terms.

5. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose
Attempt to reverse-engineer, decompile, or tamper with the app or infrastructure
Disrupt or interfere with the Service's operation, servers, or networks
Use automated scripts or bots to interact with the Service
Use the Service in a way that could harm, endanger, or harass others
Attempt to gain unauthorised access to other users' game sessions

6. Game Rules and Photo Validity

Tilesy currently supports Trust mode. In Trust mode, photo validity is not automatically verified by Tilesy. Players, hosts, teachers, organisers, or guardians are responsible for deciding whether photos satisfy the game rules.

Referee mode may be introduced later, but it is not guaranteed to be available at all times or for all games.

7. Intellectual Property

All content in the Service that is not User Content, including the app design, graphics, mascot, challenge lists, text, and software, is owned by or licensed to Tilesy and is protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from any part of the Service without our prior written permission.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

Game data is automatically deleted 24 hours after a free game ends, or 7 days after a Premium game ends.

9. Safety and Real-World Activity

Tilesy is a real-world photo bingo game. You acknowledge that participating may require physical movement and photography in real-world environments. You are responsible for your own safety and the safety of those around you while playing.

Always be aware of your surroundings. Do not trespass, endanger yourself or others, drive distracted, photograph private spaces without permission, or break any laws in pursuit of a tile.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. We do not warrant that any defects in the Service will be corrected.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TILESY AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR PERSONAL INJURY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

Our total aggregate liability for any claims relating to the Service shall not exceed the greater of the amount you paid us in the 12 months before the claim, or €10 EUR.

12. Indemnification

You agree to indemnify, defend, and hold harmless Tilesy and its affiliates from and against any claims, liabilities, damages, losses, and expenses arising out of or relating to your use of the Service, your User Content, your violation of these Terms, or your violation of any third-party rights.

13. Third-Party Services

The Service may integrate with third-party services including Google Firebase, analytics tools, crash reporting tools, Apple App Store, and Google Play. Your use of those services is subject to their respective terms and policies.

14. Termination

We reserve the right to suspend or terminate access to the Service at any time and for any reason, including violation of these Terms, without notice or liability.

15. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Continued use of Tilesy after changes are posted constitutes acceptance of the revised Terms.

16. Governing Law

These Terms are governed by applicable law. If you are a consumer in the European Union, you also benefit from the mandatory consumer protection provisions of your country of residence.
